Peeps in Law Part Deux: The Passing of Pink Peep
The Passing of Pink Peep
By Margaret Robison Kantlehner, associate professor at Elon School of Law and Wills Clinic faculty adviser
Peep into the coop where Pink’s peeps are mourning the passing of Pink and two of her progeny, Purple I and Purple III. Purple II is less blue, having pondered Pink, Purple I and Purple III’s intestate demise in North Carolina. Had Pink, Purple I and Purple III been domiciled in a per stirpeeps jurisdiction, Purple II would have received the same share that he will receive in N.C., but his orphaned nieces and nephews would not receive equal shares. Had Pink, Purple I and Purple III been domiciled in a per capeepta jurisdiction, Purple II would have received the same share as all the orphaned youngsters with no financial nod to his closer degree of kinship to Pink. A North Carolina domicile is just right! The hybrid intestacy structure acknowledges his closer kinship to Pink and treats all his orphaned nieces and nephews equally!
