NOTICE BY THE SECRETARY OF THE AMERICAN BAR ASSOCIATION REGARDING MEETING OF THE MEMBERSHIP

This is to notify members of the American Bar Association that the meeting of the membership will be held in conjunction with the Meet the Candidates Forum, August 10, 2014 at 9:30 a.m. in ballroom C of the Hynes Convention Center in Boston, Massachusetts.

PROPOSED AMENDMENTS TO THE CONSTITUTION, BYLAWS AND HOUSE RULES OF PROCEDURE

Proposed amendments to the Constitution, Bylaws and House Rules of Procedure of the American Bar Association summarized below have been duly filed with the Secretary of the Association by the indicated sponsoring members of the Association for consideration by the House of Delegates at the 2014 Annual Meeting in Boston, Massachusetts. Copies of the full text of these proposals will be published in the E-book of resolutions to the House of Delegates and are also available on the ABA’s website on the House of Delegates Leadership Page (click on Executive Summaries). These proposals are also available to any member upon request to the Division for Policy Administration at the American Bar Association, 321 N. Clark Street, Chicago, IL 60654; 312/988-5230.

Notice is hereby given that Edward Haskins Jacobs proposes to amend § 1.2 of the Association’s Constitution to include the following language as one of the purposes of the Association: “to defend the right to life of all innocent human beings, including all those conceived but not yet born.”

II Notice is hereby given that William M. Hill (Principal Sponsor), Andrew D. Ness, Terrence L. Brookie, and Steven B. Lesser propose to amend § 10.3 of the Association’s Constitution, and § 32.1(d) of the Bylaws to change the name of the “Forum Committee on the Construction Industry” to the “Forum on Construction Law.”

Notice is hereby given that Andrew D. Ness (Principal Sponsor), Bennett P. Applegate, Sherrod Banks, Robert Stevens Span, Steven Herbert Taylor, David J. A. Hayes III, Steven D. Zansberg, Charles D. Tobin, Terrence L. Brookie, Steven B. Lesser, Richard J. Idell, Janine Small, Deborah S. Coldwell, and Joseph J. Fittante, Jr. propose to amend § 10.3 and § 13.1(c) of the Constitution, and Article 32 of the Bylaws to change all references from “forum committee(s)” to “forum(s)” and to amend the names of each of the six ABA Forums by deleting the word “Committee” therefrom.

Notice is hereby given that Daniel W. Van Horn (Principal Sponsor) and Mary Smith propose to amend § 3.1 and § 3.3 of the Constitution to include individuals in good standing of a tribal court of any federally recognized tribe as members of the Association.

Notice is hereby given that Daniel W. Van Horn proposes to amend Article 3 and § 6.6 of the Constitution, and Article 21 and § 30.5 of the Bylaws to create a new lawyer member category for international lawyers.

Notice is hereby given that Daniel W. Van Horn (Principal Sponsor) and Mark D. Agrast propose to amend § 21.6 of the Bylaws to eliminate paragraph (b), thus removing the Disability Waiver Program.

Notice is hereby given that Christopher B. Hockett (Principal Sponsor) , Howard M. Feller, Roxann E. Henry, Deborah A. Garza, Pamela Jones Harbour, Brian R. Henry, Jonathan M. Jacobson, William C. MacLeod, Bernard A. Nigro, Mark S. Popofsky, Douglas C. Ross, Theodore Voorhees, Jr., and Gary Zanfagna propose to amend § 30.5 of the Association’s Bylaws, to allow non-U.S. lawyer associates to serve on the Council and in the leadership of the Section of Antitrust Law in accordance with their respective bylaws.

Notice is hereby given that William L. Penny (Principal Sponsor), Lee A. DeHihns Ill, and Sheila Slocum Hollis propose to amend § 30.5 of the Association’s Bylaws, to allow non-U.S. lawyer associates to serve on the Council and in the leadership of the Section of Environment, Energy and Resources in accordance with their respective bylaws.

IX Notice is hereby given that Donald D. Slesnick (Principal Sponsor), Cynthia Nance and Keith Frazier propose to amend § 30.5 of the Association’s Bylaws, to allow non-U.S. lawyer associates to serve on the Council and in the leadership of the Section of Labor and Employment Law in accordance with their respective bylaws.

Notice is hereby given that Estelle H. Rogers (Principal Sponsor), Michael H. Reed, Peter Bennett, Hon. Norma L. Shapiro, Wm. T. (Bill) Robinson III, Stephen N. Zack, and Dick Semerdjian propose to amend § 31.7 of the Association’s Bylaws to eliminate the Standing Committee on Federal Judicial Improvements and the Standing Committee on Judicial Independence and create one entity, the Standing Committee on the American Judicial System.

Notice is hereby given that Anthony Barash (Principal Sponsor), David Bienvenu, Michael S. Greco, Carolyn B. Lamm, Stephen N. Zack, H. Thomas Wells, Jr., Edith Osman, James Baillie, N. Lee Cooper, Sandra McCandless, Karen J. Mathis, Sharon Stern Gerstman, and Frank X. Neuner propose to amend § 31.7 of the Association’s Bylaws to reconstitute the Special Committee on Disaster Response and Preparedness to the Standing Committee on Disaster Response and Preparedness.

Notice is hereby given that Andrew D. Ness (Principal Sponsor), Bennett P. Applegate, Sherrod Banks, Robert Steven Span, Steven H. Taylor, David J. A. Hayes III, Steven D. Zansberg, Charles D. Tobin, Terrence L. Brookie, Steven B. Lesser, Richard J. Idell, Janine Small, Deborah S. Coldwell, Joseph J. Fittante, Jr., Henry Root, and Leonard Glickman propose to amend § 32.1(c) of the Association’s Bylaws to eliminate the requirement that to become a member of a forum requires membership in at least one section.

Notice is hereby given that Mary L. Smith, Roula Allouch, Michael G. Bergmann, Lajuana Davis, David R. Gienapp, Lee S. Kolczun, and Robert D. Oster propose to amend § 2.1 and § 6.3 of the Association’s Constitution to define “accredited” and to clarify that the person elected as State Delegate must be accredited to the state for which elected.

Notice is hereby given that Mary L. Smith, Roula Allouch, Michael G. Bergmann, Lajuana Davis, David R. Gienapp, Lee S. Kolczun, and Robert D. Oster propose to amend § 4.1 of the Association’s Constitution to require that notice of the annual meeting shall be given to members of the Association 60 days in advance as opposed to six months.

Notice is hereby given that Mary L. Smith, Roula Allouch, Michael G. Bergmann, Lajuana Davis, David R. Gienapp, Lee S. Kolczun, and Robert D. Oster propose to amend the Association’s Constitution and Bylaws as follows: (a) § 10.1(b) to authorize the Board of Governors to consider any requests regarding bylaw amendments of sections and divisions; (b) § 30.6 to authorize the Board of Governors to consider any requests of sections and divisions to modify their dues structures; and (c) § 30.7 to clarify that the Board of Governors no longer considers and approves the times and locations of meetings of sections and divisions.

ABE ANNUAL MEETING OF MEMBERS

The Annual Meeting of Members of the American Bar Endowment will be held in conjunction with the ABA Annual Meeting in Boston on Monday, August 11, 2014, at 7:45 A.M. in the Hynes Convention Center. The purpose of this meeting is: (1) to elect two members to the Board of Directors for a term of five years and (2) to transact such other business that may properly come before the meeting. All members of the American Bar Association are members of the American Bar Endowment.
