Judge rebukes police department for emailing trial summaries in case in which officer is defendant

A judge rebuked the Indianapolis police for emailing trial summaries to members of the department in a case in which some of those reading the accounts could be called as witnesses.

A prosecutor found out about the emails and alerted the court, reports the Indianapolis Star.

“There’s potential that this could produce a mistrial,” attorney Jack Crawford, who is not involved in the case, told the newspaper. “When the trial starts, the judge admonishes both sides to instruct all witnesses that they are not to try and gain information about what other witnesses have testified to at the trial before they testify.”

At issue in the case is suspended police officer David Bisard, who is the defendant in a drunken driving and reckless homicide trial.
