Prosecutor was so drunk he may have lacked intent in ambulance worker assault, assistant DA says

A prosecutor who has been suspended from his job in the Brooklyn District Attorney’s office was sentenced to 10 days of community service on Wednesday for assaulting an ambulance worker.

The prosecutor, Michael Jaccarino, was accused of choking an emergency medical technician with his forearm after managing to wrest himself from a gurney, report the New York Times and the New York Daily News. The EMT, Teresa Soler, told the Daily News that Jaccarino had nearly killed her before two men came to her rescue.

Jaccarino was being taken to the hospital on Nov. 10 after he was found wandering on the Brooklyn Bridge. Manhattan Assistant District Attorney Sherita Walton told a judge on Wednesday that Jaccarino was so drunk on the night in question that it would be difficult to prove he had the intent needed for a felony assault charge. He pleaded guilty to reckless assault, a misdemeanor.

Jaccarino’s lawyer, Gary Farrell, said his client was “in a state of delirium” on the night of the assault, and he had made “a catastrophic mistake,” according to the Times report.
