The writer has conflated the 1998 incident with the 2001 incident. This lawsuit was filed by the victim of the 1998 incident, and there was no witness. The Freeh report contains multiple emails between PSU administrators referencing the incident.

I don’t think I wopuld hang my hat on the Freeh report. That is a flawed document.
