Chilly indeed.  It does look kind of bad when a supposed bar association doesn’t know its 1L Constitutional Law.

Kudos to the Kentucky Bar for turning Berry’s claim into a successful derivative action, where one party pays all the lawyers.  Maybe it should go out of the region for legal advice (though, in fairness, the Stites’ lawyers also probably told it it was wrong).

As a member of the KY Bar Association, I want an explanation of how Bar Counsel let this case go this far and whether the KBA Board of Governors were apprised of this financial exposure.
