SInce FISA involves domestic surveillance, this action is unconstitutional because due process rights are ignored.  That is why a privacy group directly petitioned the Supreme Court for immediate review.  See:  http://whnt.com/2013/07/08/supreme-court-asked-to-stop-nsa-domestic-surveillance/
