A DNA First: Woman’s Murder Conviction Overturned

A judge has set aside the conviction of a New York woman in the first case of a woman convicted of murder to be freed based on DNA evidence.
Lynn DeJac was released yesterday after more than 13 years in prison, Newsday reports. Howver, prosecutors plan to retry DeJac for manslaughter.
DeJac had been convicted of strangling her 13-year-old daughter after her boyfriend testified against her on a grant of immunity. The tests show DNA from blood in the room where the girl’s body was found belonged to the boyfriend, Dennis P. Donahue, the New York Times reports.
DeJac’s lawyer, Andrew LoTempio, had sought the test after Donahue was charged with a different murder in September, the Times says.
