Lawyer Asks Judge if 11-Year-Old Suspected of Killing 6-Year-Old Brother Can Attend Funeral

The defense attorney asked a judge if an 11-year-old boy charged with murder and reckless homicide in the shooting of his 6-year-old brother could be released from custody to attend the victim’s funeral Thursday. Attorney John Boren told the judge that the boy poses no danger to himself or anyone else.

The shooting, which occurred while the two boys were alone at their Indiana home, was reported to 911 by the 11-year-old, the Indianapolis Star reports. No decision has been made on charges against the children’s mother and her boyfriend, who left the boys unattended.

The judge on the matter says he will decide whether to release the boy in consultation with juvenile detention officials. The prosecution has not yet determined whether he will be tried as an adult, the Star reports.
