$75K fine for fatal train trestle accident during movie filming is upheld on review

A $74,600 fine imposed on the producers of the movie Midnight Rider over a fatal train accident that occurred during filming of the movie has been effectively upheld on appeal.

The Occupational Safety and Health Review Commission last week declined to hear an administrative appeal, which frees the producers to take the matter up in federal court, reports Variety.

The 2014 accident occurred on a Georgia train trestle high above a river. Those making the movie thought no train would be using the tracks, but were mistaken. The sudden arrival of a train sent crew members running for their lives. A 27-year-old camera assistant named Sarah Jones was fatally injured.

Production of the movie, a biopic of the musician Gregg Allman, was suspended after the death.

A criminal manslaughter case was also pursued over the accident.
