8-Year-Old Sued for Ski Collision

A skier on vacation in Colorado is suing an 8-year-old boy who he blames for a collision in January at Beaver Creek in Vail.

David Pfahler, 60 of Allentown, Pa., claims Scott Swimm, then 7, was skiing recklessly and too fast, causing a collision that left Pfahler’s shoulder tendon to tear, UPI (which asserts that Pfahler is from Colorado) and the Associated Press report.

Scott’s father denies his son was skiing too fast. The boy’s mother was incredulous at the suit’s filing. Pfahler is asking for $75,000 in medical and other expenses.

“Who in the world sues a child?” Susan Swimm is quoted saying. “It just boggles my mind every day.”

UPI notes that Colorado law forbids suing a minor and that part of the suit is likely to be dismissed.
