Cameron and Tyler Winklevoss, twin brothers who say that Facebook was their idea, will not get an en banc rehearing on a recent opinion ordering them to accept a settlement deal with founder Mark Zuckerberg, the San Francisco-based 9th U.S. Circuit Court of Appeals ruled today.

Tyler Winklevoss declined comment Monday, the Associated Press reports.

The Winklevosses and Zuckerberg were classmates at Harvard University, where Facebook was conceived. In 2008, the brothers agreed to settle their Facebook lawsuit for $65 million in cash and stock. They later claimed that Facebook did not disclose an accurate value of its shares when the settlement was reached, and the agreement should be voided.
