9th Circuit tells Google to take down YouTube clip, calls threats to plaintiff irreparable harm
A woman who says a video clip was used without her permission on an anti-Muslim movie trailer posted on YouTube has won a federal appeals court OK of an injunction requiring Google Inc. to take down the “Innocence of Muslims.”
Google unsuccessfully argued that being required to take down the YouTube clip would be an unconstitutional prior restraint, reports Reuters.
In a 2-1 opinion, the 9th U.S. Circuit Court of Appeals held on Wednesday that Cindy Lee Garcia would likely prevail on the merits of her copyright claim. Meanwhile, the “serious threats against her life” resulting from the film pose an irreparable harm if the court order wasn’t granted, the majority said.
