Conduct of judge arrested for alleged domestic assault might be impeachable, judicial council says

The actions of a federal judge arrested for an alleged domestic assault may have been grounds for impeachment, according to an order by a federal judicial council.

The Alabama judge, Mark Fuller, announced his resignation on Friday, almost a year after his arrest for alleged domestic abuse. At the time, his lawyer had no comment on the status of a special judicial committee assigned to investigate.

On Monday, the Judicial Council of the Atlanta-based 11th U.S. Circuit Court of Appeals weighed in. Its order said it had adopted the findings and recommendations of the special committee, and Fuller’s conduct “might constitute one or more grounds for impeachment.” The Daily Report (sub. req.), the Montgomery Advertiser and the Associated Press have stories.

Fuller’s resignation is effective on Aug. 1. He has not heard cases since his arrest for allegedly assaulting his then-wife at the Ritz-Carlton in Atlanta. A battery charge was dismissed after Fuller completed a pretrial diversion program that included counseling for domestic violence.
