An assistant district attorney in Travis County, Texas, has agreed to remove himself from the aggravated assault trial of a Marine veteran because he used a curse word—in front of jurors—to describe the defense lawyer.

The story by the Austin American-Statesmen does not identify the word used by Assistant District Attorney Jim Young, but does indicate in a quotation that it began with an “M.” Young was a third-chair prosecutor in the trial of Gene Vela, charged as a result of a November 2013 standoff with police.

Judge Bob Perkins said on Monday that he didn’t hear Young’s remark about defense lawyer Skip Davis, and he doubted jurors had heard it, the story says.
