Associate's detective work helps get case moved from New York to California

An associate who checked out a company’s purported place of business has helped win the transfer of a federal patent case from New York to California.

The plaintiff, Israel-based IXI Mobile, had claimed it had a subsidiary in New York City with a principal place of business at the Chrysler building. But an associate at Simpson Thacher & Bartlett said she walked to the address and found no evidence the company had an office there, the Recorder (sub. req.) reports.

No one at the lobby desk had heard of the company, according to the associate, Elizabeth Gillen.

IXI Mobile claims patent infringement of its mobile hotspot technology by Apple, BlackBerry and Samsung Electronics. U.S. District Judge Richard Sullivan said the location of key witnesses supports transfer of the case to California.
