The aunt of a 3-year-old boy who drowned at an Oleta River State Park beach in Florida has been charged with aggravated manslaughter, apparently because authorities felt she didn’t keep a close enough eye on him to prevent the accident.

Nico Foster was also watching five other children when Kieonn Foster went underwater. Two teens found his body floating near some buoys in six feet of water, and he couldn’t be revived, reports CBS 4.

“When you’re watching over any group of kids, it should never be beyond your span of control, and in this situation it appears that it was,” said North Miami Police Lt. Neal Cuevas.
