A bankruptcy trustee is suing Georgia’s superintendent of schools in an effort to get $1 million in prize money the educator had planned to give to charity.

Georgia Superintendent of Schools Kathy Cox won the money during an appearance on the Fox show Are You Smarter than a 5th Grader? the Associated Press reports.

Cox announced she would give the money to three public schools for the deaf and blind. But a bankruptcy trustee says the prize money should be applied to the $3.5 million in debts claimed in a Nov. 17 bankruptcy filing by Cox and her husband.

The state, on the other hand, contends Cox appeared on the show to win money for charity, and the schools are entitled to the money, according to the story.
