California’s Supreme Court has agreed to take on an age discrimination suit against Google by a man who claims he was marginalized and his job eliminated.

The 58-year-old plaintiff, Brian Reid, claims younger co-workers referred to him as “old man” and “fuddy-duddy,” Financial Week reports.

Google has stated that Reid, whose case has yet to be tried, was fired because the in-house graduate degree program he worked on was discontinued by the company, Financial Week notes.

But Reid has compiled stats that show that Google, like many in the tech sector, has a young workforce. In 2004, only 2 percent Google’s employees were older than 40.

Los Angeles employment lawyer David Greenberg told Financial Week that it’s probably a good thing for Google that the state supreme court decided to hear the case. “It usually suggests that either they don’t agree with the lower court decision or that there are conflicting decisions in the lower courts.”
