A Florida couple has dropped their lawsuit contending that United Airlines was responsible for a woman’s beating by her husband because it served him too much alcohol on a flight from Japan.

A federal court dismissed the case after Yoichi and Ayisha Shimamoto sought dismissal on Dec. 23, the Chicago Tribune reports. The suit, filed earlier in the month in Tampa, Fla., had sought defense and other costs associated with the criminal case against Yoichi Shimamoto, who was prosecuted for disorderly conduct and sentenced to probation.

Legal experts had said the Warsaw Convention governing overseas flights would likely doom the couple’s quest for damages.
