A federal appeals court issued an order yesterday requiring anti-Fidel Castro Cuban militant Luis Posada Carilles to remain in jail.

The 5th U.S. Circuit Court of Appeals, based in New Orleans, acted in response to an emergency motion, the Associated Press reports.

Posada has been in custody since his arrest in 2005 for entering the United States illegally. Venezuela and Cuba are seeking his extradition to Venezuela be tried in the 1976 bombing of a Cuban jetliner.

A federal judge ruled in 2005 that Posada should not be sent to either country because of concerns he may be tortured.
