DA Wants Judge Investigated

A district attorney in Conroe, Texas, says he will seek a special prosecutor to investigate a judge who jailed a lawyer for missing a hearing.

Montgomery County, Texas, District Attorney Michael McDougal told Texas Lawyer he would file a motion on Friday for a special prosecutor to investigate Judge Frederick Edwards.

The judge ordered solo practitioner Norman Silverman jailed in December 2006 because he failed to show up for a hearing the previous day.

Silverman, who spent more than six hours in jail, says he missed the hearing because he twisted his ankle. Silverman says he asked another lawyer to notify the judge he couldn’t attend, but the message was never delivered.
