Dewey leaders won't testify in retrial for alleged scheme to mislead law firm lenders
Two former leaders of Dewey & LeBoeuf won’t testify in their retrial for allegedly misleading lenders and auditors about the law firm’s finances before its collapse.
Lawyers for former chief financial officer Joel Sanders and former executive director Stephen DiCarmine indicated on Monday that they won’t be calling any witnesses, the New York Law Journal (sub. req.) reports. They took the same tack in the first trial, which ended in a mistrial after jurors said they were “hopelessly deadlocked” on many of the charges.
Former law firm chairman Steven Davis was also charged, but he reached a deferred prosecution agreement after the first trial.
According to the New York Law Journal, prosecutors in the retrial “presented a relatively stripped-down case.” Prosecutors cut the number of charges from about 50 counts against each defendant to just three counts each, according to a prior Law.com (sub. req.) story.
The retrial got underway with opening statements in early February. The case could go to the jury next week.
