Stunned to learn that he has breast cancer, Raymond Johnson, 26, was then hit hard by another round of bad news.

Under federal law, the uninsured tradesman from South Carolina doesn’t qualify for Medicaid because he is male, reports the Post and Courier.

He says the sex-based policy that state officials tell him is mandated by the federal Breast and Cervical Cancer Prevention and Treatment Act is unfair, and they agree.

In a statement made public on Friday, the state Department of Health and Human Services urged the Centers for Medicare & Medicaid Services to rethink this approach, as it has also done in a similar situation earlier.

“We are again urging CMS to reconsider,” the statement says. “It’s a very clear example of how overly rigid federal regulations don’t serve the interests of the people we’re supposed to be helping.”
