A Dutch lawyer claims his 500-pound client, who is a couple inches shy of 7 feet tall, is too big for his jail cell.

Lawyer Bas Martens maintains that his client’s 12-square-yard jail cell violates European human rights law, the Associated Press reports.

Martens told a court in The Hague that his client has to “wedge” into the cubicle when taking a shower, according to the Daily Mail Online, which spells the lawyer’s name “Martyens.” The prisoner “sleeps with one eye open” to avoid falling out of his too-small bed, the lawyer said, and keeps his use of the toilet “to the absolute minimum” because it is so tiny and low.

Martens is seeking house arrest with electronic monitoring for his client, who was jailed in September for financial fraud. “He is a giant of a man,” Martens told AP in an interview. “There’s no way you cannot realize that as soon as you see him.”
