Employers Leery of EEOC Family-Bias Agenda

Employers fear the Equal Employment Opportunity Commission will draft a new rule that will make it more difficult to defend claims of family responsibility discrimination.

More than 100 lawsuits are pending that claim employers discriminated against workers because of their family care-giving responsibilities, according to the National Law Journal. Such suits are often based on Title VII of the Civil Rights Act of 1964, the Pregnancy Discrimination Act or the Family and Medical Leave Act.

The EEOC announced last month it may develop enforcement guidelines to deal with such discrimination.

“I am concerned that the EEOC might move toward making it easier to assert claims that are not necessarily justified by the statutory language of the statutes,” Clare Draper, of Atlanta’s Alston & Bird, told the legal newspaper.
