Employers Limit Time for Suits Through Job Applicant Waivers

Employers are increasingly adding some fine print to job applications that limits the time period in which new employees can file workplace lawsuits.

Many waivers limit the time for filing suit to six months, the National Law Journal reports.

Mike Palese, a spokesperson for DaimlerChrysler Corp., told the publication that job applications from several company websites have the waivers. Chrysler’s waiver was upheld in a 2005 decision by the Michigan Court of Appeals in an age discrimination lawsuit and in other decisions.

“As you know, we live in a very litigious society, and at the end of the day, it’s very important for Chrysler to be managing a legal system that’s predictable,” he said.

Chrysler’s opponent in another case, Ohio lawyer Denise Knecht, recently lost her challenge to the waiver before a federal judge. She warns other lawyers “to get copies of personnel files right away so they can know right away whether their clients have waived their rights or not,” according to the story.
