Expert Witness Issues Often Critical; List Cites 10 Top Cases of 2008

As evidence, especially in the age of Internet technology, becomes an ever-expanding and more complex field, courts often struggle to determine the appropriate parameters of expert testimony.

A list compiled by Robert Ambrogi in the BullsEye Newsletter lists what he says are the top 10 cases of 2008 concerning expert testimony.

Among them, U.S. District Senior Judge Edward Harrington imposed $10 million in sanctions, due to an obfuscation campaign involving expert witnesss, in Depuy Spine Inc. v. Medtronic Sofamor Danek Inc.., the article recounts.

Medtronic "clearly sought to take advantage of the technical and legal complexities inherent in this case," the judge wrote in his Feb. 25 opinion on the case.
