A federal judge in Mississippi has given the green light to a lawsuit filed by a lesbian teenager over her high school yearbook senior photo.

U.S. District Judge Dan Jordan last week denied a motion to dismiss Ceara Sturgis’ claim that the Copiah County School District discriminated against her by refusing to allow her to wear a tuxedo in the photo, as male classmates were allowed to do, reports the Associated Press.

While Sturgis, 19, has now graduated, a representative of the American Civil Liberties Union, which is representing her in the case, says the case is being pursued in an effort to change the district’s policy.

The district declined the AP’s request for comment.
