Former Nixon Peabody associate is awarded $266K in suit claiming bonus underpayment

A former associate at Nixon Peabody who claimed Nixon Peabody underpaid his bonus has been awarded nearly $266,000.

The lawyer, Noah Doolittle, had claimed that his bonus of $75,000 for bringing in a key client was too low, and that he was entitled to a promised bonus of 5 percent of the $5.32 million in fees collected from the client in 2008. Jurors awarded Doolittle $266,000 on June 20, the New York Daily Record (sub. req.) reports. Above the Law has a summary of the article.

Nixon Peabody will also be on the hook for an additional penalty that has to be paid to Doolittle for violating labor law, according to Doolittle’s lawyer, Nelson Thomas. He told the Daily Record his guess was that the penalty, with interest, will amount to between $400,000 and $500,000. The firm will also have to pay legal fees that could top $500,000, he said.

A Nixon Peabody spokesperson sent this statement to the ABA Journal: “While he was employed at Nixon Peabody, the firm paid Mr. Doolittle in accordance with its established salary and bonus policies. We believe Mr. Doolittle was compensated fairly for the work he did in this matter.”
