Likely Antitrust Nominees: Harvard Law Prof and FTC Commissioner

Harvard law professor Einer Elhauge and Federal Trade Commission commissioner Jon Leibowitz are likely to be nominated to the nation’s two top antitrust jobs, a wire service is reporting.

Elhauge is expected to be named to head the Justice Department’s antitrust division, Reuters reports, and Leibowitz is expected to be nominated to lead the Federal Trade Commission. The report is based on “antitrust sources who have been following the matter.”

The article says three other lawyers are on a short list of candidates to lead Justice’s antitrust division. They are Jan McDavid of Hogan and Hartson, Douglas Melamed of WilmerHale, and William Baer of Arnold and Porter.

Elhauge and Leibowitz were also mentioned as possible antitrust chiefs in a Jan. 2 Bloomberg story that also named Baer as a possible candidate. Melamed and McDavid weren’t listed in that report.
