A former Illinois lawyer who held on to nude photos of his 16-year-old sister-in-law won’t get a Supreme Court hearing in his child pornography case.

Gary Peel had kept the photos from an affair he had with the sister-in-law in 1974. They came to light when he tried to pressure his ex-wife into a more favorable divorce settlement. The Supreme Court denied cert today, the Associated Press reports.

Peel had contended the child porn statute wasn’t even adopted when he took the photos, and it didn’t ban pornographic photos of 16 and 17 olds until amended in 1984.
