Hockey Star's Winning DUI Argument: Knee Surgeries Caused Field Sobriety Test Glitch

Saying that a videotape of field sobriety tests didn’t establish probable cause to arrest hockey star Chris Chelios for driving under the influence, an Illinois judge yesterday cleared the way for the expected dismissal of the DuPage County case against the former Chicago Blackhawks star.

Attorney Terry Ekl, who represented the 48-year-old Chelios, argued that he briefly put his foot down when asked to stand on one leg during a field sobriety test because of his 10 knee surgeries, reports the Naperville Sun.

Chelios, who refused a breath-alcohol test, also swayed slightly when asked to walk a straight line. But Judge Cary Pierce told prosecutor William Opal, after viewing the videotape, “there’s got to be probable cause to go forth. think you’re just a little short in this case,” the newspaper recounts.

Chelios now plays in the American Hockey League for the Chicago Wolves.
