Hospitality contractor claims it owns Yosemite trademarks

A contractor that lost its hospitality contract with the National Park Service says it owns trademarks to “Yosemite National Park” and the names of places within the park.

In a suit filed in the Court of Federal Claims, Delaware North Parks & Resorts Inc. is seeking compensation for the new contractor to use the trademarks, report the Litigation Daily, the Buffalo News and the San Francisco Chronicle. Delaware North has previously valued its intellectual property at up to $51 million.

Delaware North claims it acquired the trademarks for $61.5 million when it took over the handling of food and lodging in the park 22 years ago. Since then, Delaware North says, it has maintained the trademarks and created new ones.

According to Delaware North, its 1993 contract says it is entitled to compensation for the trademarks from any contractors that take over its job. Delaware North says it took the value of its intellectual property into account when it submitted a bid on a new contract.
