An injured Amtrak employee is among the first to sue over this week’s fatal train wreck in Philadelphia.

Bruce Phillips filed a federal lawsuit in the Eastern District of Pennsylvania under the Federal Employers’ Liability Act.

His lawyer, Michael Olley of Coffey Kaye Myers & Olley, said the suit is the first filed by his firm, which had been waiting for all passengers to be accounted for, the Legal Intelligencer (sub. req.) reports.

Phillips was not a member of the Amtrak crew working that night but was taking the train to New York.
