Judge axes indictment against lawyers in witness-tampering case, citing improper testimony

Citing evidentiary issues including hearsay, improper opinion testimony and irrelevant testimony, a judge on Wednesday dismissed a witness-tampering case against a New York lawyer and his associate.

While the decision by Justice David Zuckerman does not prevent prosecutors from going back to square one and attempting to get another Putnam County grand jury indictment against attorney George Galgano and Eric Sharp, attorney Benjamin Brafman, who represented Galgano, said he would be surprised if prosecutors try again, the New York Law Journal (sub. req.) reports.

A spokeswoman for the Putnam County District Attorney’s office said prosecutors will review their options after reading a special master’s report.
