Accused of having improper ex parte communications without a prosecution representative present, the judge in the Lindsay Lohan case has stepped aside.

Although there appears to be little more for the new judge to do, now that the 24-year-old actress has been released from jail and gone into rehab, Judge Elden Fox will oversee the Los Angeles Superior Court case from this point forward, reports Reuters.

Lohan served 13 days for violating her probation in two drunken-driving cases.

Judge Marsha Revel “was having calls and discussions with people on the case, and we were not present,” Jane Robison of the Los Angeles District Attorney’s office tells the news agency.
