Appearing before Senior District Judge Paul Davis in jailhouse stripes, an Austin, Texas, attorney won a significant reduction in his 90-day contempt sentence for making an obscene gesture in court during a hearing.

Because Adam Reposa’s girlfriend is pregnant and due to give birth in a month, Davis said, he is requiring Reposa to serve only 10 days of his time before he is allowed to participate in a work-release program that permits him to stay out of jail. He must also wear an electronic monitor, reports Texas Lawyer.

Four judges also testified at a Wednesday hearing in the Travis County case that Reposa’s conduct had improved since Davis sentenced him to the 90-day contempt term. They were subpoenaed to testify by Reposa’s lawyer, solo Todd Dudley of Austin.
