Judge's Defense in Ethics Case: 'Diminished Capacity'

An Alabama judge facing a 60-count Judicial Inquiry Commission ethics case filed his response to the allegations yesterday.

His defense: a “diminished capacity” for rational decision-making, reports the Associated Press.

A lawyer for Judge Stuart DuBose declined to elaborate on the reasons why he has been struggling with decision-making. However, the pleading says the jurist’s “treatment and evaluation concerning his health, both mental and physical, is ongoing,” the news agency reports.

His circuit court seat covers Clarke, Choctaw and Washington counties.
