Kagan's Professed ‘Judicial Hero’ Should Disqualify Her from Court, Bork Says

In 2006, Elena Kagan identified the chief of Israel’s Supreme Court as her “judicial hero” because of his support for human rights and rule of law.

Failed Supreme Court nominee Robert Bork doesn’t share Kagan’s enthusiasm, according to The BLT: The Blog of Legal Times and the Washington Post.

In a conference call with reporters on Wednesday, Bork said Kagan’s admiration for former Israeli Justice Aharon Barak is “disqualifying in and of itself.” Bork said Barak is an activist who is possibly “the least competent judge on the planet.”

Bork’s views on Barak are shared by other conservatives, the BLT says. One of them is Judge Richard Posner of the Chicago-based 7th U.S. Circuit Court of Appeals, who has criticized Barak’s expansion of judicial powers in Israel.
