Law firm sues, says rival legal shop lured associate and encouraged him to solicit clients

A Wilkes-Barre, Pa., law firm has filed suit against a competitor, contending that the rival legal shop not only lured its associate to new employment but encouraged him to solicit its clients while still on the original firm’s payroll.

Even though associate Paul Batyko was still working out his two-week notice to Rosenn, Jenkins & Greenwald, he started doing work for his new employer, the Comitz Law Firm, and encouraging Rosenn clients to defect to the Comitz firm along with him, says the Luzerne County legal action. It asserts claims for alleged civil conspiracy, tortious interference, and aiding and abetting a breach of fiduciary duty, the Citizens’ Voice reports.

Officials at the Kingston Township-based Comitz firm declined to comment when contacted by the newspaper.
