Law Prof Finds Fame After Lindsay Lohan Tweets His Article

Washington and Lee University law professor Erik Luna is aware of Lindsay Lohan’s work in just one film: The Parent Trap, a favorite of his 9-year-old daughter.

It appears Lohan is familiar with Luna’s work based on just one article, a critique of the federal sentencing guidelines, according to the Washington and Lee University School of Law in an article reproduced by NewsLeader.com. Lohan tweeted quotes from Luna’s article to protest her 90-day sentence for violating probation in two 2007 cases of driving under the influence.

Luna identifies a few problems with Lohan’s reference to his 2002 article. “First, it’s dated,” he says in the Washington and Lee story. “Since the paper’s publication in 2002, there has been a sea change in the law. In 2005, the U.S. Supreme Court invalidated a key part of the sentencing scheme that had been the subject of my criticism. More fundamentally, Ms. Lohan’s case is in the California state system, and my critique of federal sentencing has, at best, some oblique relevance to her plight.”

In an interview with the Daily Caller, Luna joked that he is hoping for even greater Internet fame. “I’m only hoping that Lady Gaga tweets about my Fourth Amendment work,” he said.
