Lawyer Arrested for Bringing Gun to Use as Courtroom Prop

An Indianapolis lawyer is taking his lumps after his arrest last week for bringing an unloaded, but nevertheless real gun to use in a trial demonstration.

“I should have got a squirt gun or a wooden gun,” Loren Jay Comstock told the Indianapolis Star. “It was a dumb thing, not an intentional criminal act.”

County deputies arrested Comstock, 74, on a preliminary charge of carrying a handgun without a license. The charge is a misdemeanor and carries a maximum sentence of a year in jail. He spent nearly 10 hours in jail on Wednesday before being released without having to post bond.

Comstock, who planned to use the gun to show that police unlawfully searched one of his clients, noted that he’s used real guns in court in the past, but on those occasions he had a court order to do so.
