Lawyer Who Pressed Birther Case Is Elected to California Judgeship

A conservative lawyer who represented “birthers” challenging President Obama’s birth certificate has won a California judgeship.

Gary Kreep’s election lead widened to 1,569 votes on Tuesday with just 1,000 ballots left to count, according to U-T San Diego. He defeated a deputy district attorney for a spot on the San Diego superior court.

Kreep is founder and chief executive of the conservative U.S. Justice Foundation. He has represented a Marine sergeant discharged for criticizing Obama on Facebook, as well as anti-abortion activists. Asked during the judicial campaign if he thinks Obama’s presidency is legitimate, Kreep answered, “I have sincere doubts.”

According to U-T San Diego, “Kreep will now be in the spotlight as a judge, sure to be scrutinized for any indication that his conservative legal views are playing into his judicial decisions.” For his part, Kreep says he will rule based on the law and not on his views. He hopes he will be assigned to a family law court.
