When a Kentucky judge last month sentenced Brian Pollard to four days in jail for DUI, she apparently had no idea there’d been a fatality tied to the incident.

Neither did the prosecutor.

Family members are reeling over the short sentence and state police say new charges are possible, CBS WKXT reports.

Pollard’s plea came after a June crash in Scott County, Ky., that killed passenger Peggy Williamson, Pollard’s cousin.

The judge, Rebecca Phelps, declined to discuss the case, telling the news outlet that she’s not permitted to comment considering “prosecutors are saying that an additional charge may be forthcoming.”
