Man Sues Fertility Clinic, Claims Ex-Girlfriend Used Stolen Sperm to Get Pregnant
A New York man claims in a lawsuit against a Texas fertility clinic that his ex-girlfriend used in-vitro fertilization to get pregnant with sperm from their used condoms.
The plaintiff, telecommunications manager Joseph Pressil, tells the New York Post he learned about the scheme last February when he got a receipt for sperm cryopreservation in the mail. The suit (PDF) claims Pressil was listed as the “patient” on the receipt, though he never sought treatment for infertility, Click2Houston.com reports
Pressil was paying $800 a month in child support for his twins when he learned of the alleged deception, the Post says. He now has joint custody. His suit alleges negligence, conversion, conspiracy and misappropriation.
Pressil claims the former girlfriend, an exotic dancer, wanted to get pregnant in a bid to remain in his Texas home and get half his assets. “A gold digger is an understatement,” he told the Post. “She was trying to get community property and alimony. She’s ruthless.”
The defendant, the Advanced Fertility Center of Texas, told Click2Houston.com that some men don’t like visiting fertility clinics and send semen samples instead. The clinic has on file signed consent forms with Pressil’s name, and it billed his health insurance for the in vitro procedure. Pressil says he did allow his girlfriend to use his health insurance as a “domestic partner,” but he thought she was receiving treatment for a fibroid condition.
