Man v. Mom: Son Seeks to Evict His Mother, 98, From Her Home of Nearly 60 Years
Peter Kantorowski says he’s just trying to do the right thing for his elderly mother, who surely would be better off living with him or in a nursing home.
But a Connecticut court is going to decide the issue at a trial next month, after he served her with eviction papers last year on her 98th birthday to force her out of her home of nearly 60 years, reports the Connecticut Post.
Fairfield Probate Judge Daniel Caruso visited Mary Kantorowski at her home and brought in a geriatric specialist to evaluate her before appointing attorney Richard Bortolot to represent her, pro bono, with her agreement. A trial is scheduled to begin March 2 in Bridgeport Superior Court.
Although Mary Kantorowski and her now-deceased husband originally owned the house, they transferred it in 1996 to a trust administered by their son on condition that she would be allowed to live there until her death. He quitclaimed it in 2005 to a trust controlled by himself and his wife.
“This is just a despicable situation,” Bortolot told the newspaper. “Mary has been living here happily paying all the expenses for the house and now her son, Peter, comes along and is telling her, ‘Get the hell out,’ so he can sell it.”
However, Peter Kantorowski said he has his mom’s best interests at heart. “I was alarmed at the conditions she was living in,” he said. “I always believed she could live there as long as she wanted and as long as she knows what is going on, but she is now 98 and has more cloudy days than sunny days.”
