Noncompete Agreement Enforced Concerning Hewlett-Packard Exec
Siding with a company attempting to enforce a noncompetition agreement concerning a former executive, a California Superior Court judge has refused to interfere with a Massachusetts court ruling that restricts his duties at his new job at Hewlett-Packard Co.
David Donatelli, who previously headed the storage business of his former employer, EMC Corp., can still work at H-P. However, he can’t supervise H-P’s storage business, as originally planned, reports the Wall Street Journal.
Donatelli had sought to overturn the noncompetition agreement he signed in 2002 by filing suit to seek a California injunction banning enforcement. However, EMC filed competing litigation in Massachusetts, where the company is based, and where state law permits noncompetition agreements, the WSJ recounts.
