NY Lawyer, Crushed by 300-Pound Fan, Sues Mets

A Manhattan attorney who says her back was broken when she was crushed by an apparently drunken and unruly 300-pound fan who fell on her at a New York Mets game has reportedly filed suit for unspecified damages.

The suit filed by Ellen Massey, 58, names as defendants the baseball team’s owner, a beer vendor, the union for the security guards at Shea Stadium and the unknown “John Doe” who fell on her at a game last month during the team’s home opener, reports AP. The owner had a duty to keep the stadium reasonably safe, her complaint says. Meanwhile, the beer vendor should not have sold alcohol to an apparently drunken spectator, and security guards should have dealt with bad behavior by fans, it contends.

A statement issued by the Mets says the suit, filed last week, in the state’s Supreme Court in Manhattan, has no merit, and a spokeswoman for the beer vendor said the company is reviewing the complaint. The union could not be reached for comment.
