Obama Campaign Wins Round in Fight to Stop Website's Sales of 'O' Logo Items

A federal judge has handed the Obama campaign a partial victory in its effort to stop a website’s sales of merchandise with a rising sun “O” logo.

U.S. District Judge Emmet Sullivan granted a preliminary injunction barring Demstore.com from selling items with an “O” logo trademarked in 2008, report the Associated Press and The BLT: The Blog of Legal Times.

The Obama campaign says that Demstore.com cuts into its own sales of “O” merchandise. The campaign says it is also harmed by lost sales because it loses the ability to gather contact information from the buyers.

Sullivan asked for additional briefing on the campaign’s attempt to stop sales of merchandise of the campaign’s 2012 “O” logo. Though the campaign has applied for a trademark on that logo, it has not yet been granted, AP says.
